Active (since 1981) making, arranging, and servicing loans for investment, in hard money lending or "private money lending" /institutional lending. Expert witness consultation and testimony provided in State and Federal courts, arbitration proceedings, and depositions. Past President, Education Chair, present Member, Education Committee, California Mortgage Association, the trade association for the private / hard money lending industry. Teaching/speaking experience as instructor for loan origination, loan brokerage, and loan servicing seminars / classes, for the California Mortgage Association, California Association of Mortgage Professionals, National Association of Mortgage Brokers, Park University Enterprises, and seminars provided by Southwest Mortgage. Author of seminars/programs regarding loan origination, loan brokerage, loan servicing, lender, broker, loan servicer licensing, trust deed investments for private investors in hard money lending. Expert witness testimony in multiple areas, including: * the "Business Purpose Exemption," as to whether a loan was for consumer purposes or for business purposes * "Broker Involvement" cases, as to whether or not a loan was arranged by a broker, disputes over loan broker's conduct in making, arranging or servicing a loan, and disputes regarding agency relationships * disputes over underwriting, as to whether or not private money brokers or trust deed investors should have more carefully investigated loans or whether it is typical to make loans with less investigation and/or inquiry * disputes between private money investors and brokers or others with whom they invested in hard money loans, as to whether or not the loan(s) could/should have been more carefully investigated or risks better disclosed * disputes over conduct of a loan servicers or conduct of private investors when servicing their own loan * broker / lender / borrower's role in title insurance issues * fractionalized loans (updated July 2, 2022)
